This is the first post in our series on how to handle an emergency child custody case in Dayton and southwest Ohio. We decided to write this series in order to provide parents with a better understanding of how to proceed if their son or daughter is in danger. Additionally, we will be including information on what is and what is not an emergency situation. The goal of this series is to allow for a parent to make an informed decision when selecting an attorney as well as to allow parents to better understand their options. If you require assistance, please contact our office today to speak with a lawyer.
Over the next several articles, we will be addressing several topics. The issues that we will be covering and analyzing include:
- What Courts do and do not consider an emergency
- The process of filing for an emergency change of custody
- The discovery process in an emergency child custody case
- What the repercussions of a false claim are
- When to contact Child Protective Services and when not to
We chose these topics because we believe that they needed to be addressed. First, parents need to understand what is considered an emergency situation and what is simply a disagreement between parents. Second, when parents have a better understanding of the process of filing for a change of custody, things can progress more smoothly. Third, understanding the discovery process is important as it is ultimately how a parent will gather the evidence needed to prove their case. Fourth, it is very important that parents understand the ramifications of making a false claim in an effort to gain custody. Finally, it is important for parents to understand when to call and when not to call Child Protective Services.
If you believe that your child is in danger, it is very important that you contact a family law attorney as soon as possible. The longer it takes for the matter to be brought before the Court, the more likely it is that a Judge would find that there is no actual danger. By speaking with counsel immediately, one can understand all of their options and make sure that the situation is handled soundly. Our firm regularly handles these matters.
